UAE Court Dismisses Customer’s Claim Over ‘Unauthorised’ Credit Card

Abu Dhabi Commercial Court of First Instance orders customer to bear costs after failing to prove card was issued without consent.

Abu Dhabi’s Commercial Court of First Instance has dismissed a customer’s claim seeking to cancel a credit card and waive outstanding dues, holding that the bank had complied with all required procedures and that the card was issued under a valid contractual arrangement.

The claimant contended that the credit card had been issued in his name without his knowledge or consent while he was outside the country. He sought to be cleared of Dh36,419 in alleged dues, along with cancellation of the card and correction of his credit record.

However, the court noted that both the account opening request and the credit card application in the case file carried signatures attributed to the claimant. It further observed that a customer’s absence from the country does not rule out authorised use of a credit card.

A court-appointed expert confirmed that the bank had followed procedures mandated by the Central Bank and had verified the claimant’s original documents before issuing the card. The expert report also established that all transactions were carried out using the physical card and its PIN.
